If signed into law, the Notch Fairness Act would amend the Social Security Act to allow workers born between 1917-1926, often referred to as Notch Babies, to choose between a $5,000 lump-sum compensation that is payable in 4 annual installments, or an increased monthly benefit based on a pre-determined calculation.
Sen. David Vitter (LA) introduced S. 118 on January 25, 2011. This bill has been referred to the Senate Committee on Finance, where it is pending further action.
